Terms of Service

1. The Service

KLIK lets a host create an event and invite guests to capture and upload photos to a shared, private gallery. Hosts manage events through an account; guests join via a QR code or link without creating an account.

2. Eligibility and accounts

To create an account as a host you must be at least 18 years old and able to enter into a binding contract. You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us promptly of any unauthorised use.

3. Pricing and payment

KLIK is offered on a pay-per-event basis, with a free tier for small events as described on our pricing page. Prices are shown at the point of purchase. Payments are processed by our payment provider, Polar, which acts as Merchant of Record and may apply applicable taxes.

Paid features become available once payment is confirmed. Except where required by law, fees are non-refundable once an event has been activated and used. If you believe you have been charged in error, contact us at hello@tryklik.app.

4. Your content

“Content” means photos and other material uploaded to or created through the Service. As between you and KLIK, you (or the relevant host or guest) retain ownership of your Content. By uploading Content, you grant KLIK a non-exclusive, worldwide, royalty-free licence to host, store, process, resize and display that Content solely for the purpose of operating and providing the Service.

You represent that you have all necessary rights to upload your Content and that doing so does not infringe the rights of any third party or any applicable law, including in relation to the privacy and image rights of people who appear in photos.

5. Acceptable use

You agree not to use the Service to:

• upload or share content that is unlawful, defamatory, obscene, harassing, or that infringes the rights of others;
• photograph or share images of individuals without an appropriate lawful basis or where they have a reasonable expectation of privacy;
• upload malware or attempt to gain unauthorised access to the Service or its systems;
• circumvent usage limits, rate limits, or security measures;
• use the Service for any illegal purpose or in breach of these Terms.

We may remove Content and suspend or terminate access where we reasonably believe these Terms have been breached.

6. Host responsibilities

As a host, you control who you invite to your event and are responsible for the lawful operation of your event, including informing guests that photos are being collected and shared in a gallery. You act as the controller of personal data captured at your event; KLIK processes that data on your behalf as described in our Privacy Policy.

7. Availability and changes

We aim to keep the Service available and reliable but do not guarantee that it will be uninterrupted or error-free. We may modify, suspend or discontinue features at any time. We may also update these Terms; continued use after changes take effect constitutes acceptance of the updated Terms.

8. Intellectual property

The Service, including its software, design, branding and the KLIK name and logo, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our branding without our prior written permission.

9. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we exclude all warranties, whether express or implied, including as to merchantability, fitness for a particular purpose and non-infringement. We are not responsible for Content uploaded by users.

10. Limitation of liability

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. Subject to that, KLIK shall not be liable for any indirect or consequential loss, loss of data, loss of profits or loss of goodwill, and our total liability arising out of or in connection with the Service shall not exceed the greater of (a) the amount you paid to us for the event giving rise to the claim in the 12 months before the claim, or (b) £100.

11. Indemnity

You agree to indemnify and hold KLIK harmless from any claims, losses or expenses (including reasonable legal fees) arising from your Content, your use of the Service, or your breach of these Terms.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or where reasonably necessary to protect the Service or other users. On termination, provisions that by their nature should survive (including ownership, disclaimers, limitation of liability and governing law) will continue to apply.

13. Governing law and jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim, save that if you are a consumer you may also be entitled to bring proceedings in the courts of the part of the UK in which you live.
